The Divorce Process: What to Expect

First, you will be filing forms in whatever county you live in so long as you have been a resident for at least six months prior. Your Petition for Dissolution of Marriage will need to include all issues you would like addressed including dividing your property, child custody, child support, and alimony.

You will also turn over a financial affidavit to your spouse within 45 days which includes your:

You will need to serve your spouse a copy of your filed petition for dissolution. If they agree to the terms of the divorce, they can file an “Answer and Waiver of Service.”

Your petition for dissolution will need to be filed with your county clerk after it has been notarized. The clerk will then give you a copy with a date stamp and proof that it has been filed. Make sure you make a copy of the petition for your own record and to provide another copy for your spouse.
